Welcome to TapUp (“TapUp”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the TapUp website, platform, and services available at  https://tapup.in .

By accessing or using TapUp, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About TapUp

TapUp ("we", "us", "our") is a trading name operating in the India. TapUp provides a software platform that enables tradespeople and small businesses to send Google review requests to their customers via WhatsApp messaging.

2. Acceptance of Terms

By creating an account or using TapUp, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the service. We may update these terms from time to time, and continued use of the service constitutes acceptance of any changes.

3. Eligibility

You must be at least 18 years old to use TapUp. By using the Service, you confirm you have the legal capacity to enter into these Terms.

4. Your Account

You are responsible for maintaining the security of your account credentials. You must not share your login details with any third party. You are responsible for all activity that occurs under your account. If you suspect unauthorised access, contact us immediately.

5. Free Tier and Subscriptions

New users receive a limited number of free review requests. After free requests are used, a paid subscription is required to continue sending. Subscription fees are charged via Razorpay. Prices are displayed before you subscribe and may change with notice. You may cancel your subscription at any time through your account settings or the Razorpay customer portal.

6. Acceptable Use

You agree not to:

  • Send messages to people who have not been your customers or clients
  • Send spam, unsolicited messages, or messages to purchased contact lists
  • Use the service to harass, threaten, or abuse any person
  • Send messages that are misleading, fraudulent, or deceptive
  • Attempt to manipulate or incentivise reviews in violation of Google's policies
  • Use the service for any unlawful purpose
  • Reverse-engineer, copy, or resell any part of the service
  • Exceed reasonable usage limits or abuse the platform's infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Messaging and Compliance

TapUp sends messages via WhatsApp using the WhatsApp API. You are responsible for ensuring that you have a legitimate business relationship with the recipients of your messages. All messages include an opt-out mechanism ("Reply STOP to opt out") as required by PECR (Privacy and Electronic Communications Regulations 2003). You must honour all opt-out requests promptly.

8. Intellectual Property

All content, branding, software, and materials on TapUp are owned by us. You may not copy, modify, distribute, or create derivative works from our materials without written permission. Your business data and customer information remain your property.

9. Limitation of Liability

TapUp is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that messages will always be delivered. To the maximum extent permitted by law, our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.

10. Third-Party Services

TapUp integrates with third-party services including Google (for review links and business data), Facebook (for WhatsApp messaging), and Razorpay (for payment processing). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or performance of third-party services.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these terms. Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Continued use means acceptance of the updated Terms.
